1. Who this covers

This agreement is between Movement Solutions, LLC (“we”, “us”), a physical therapy practice in Greenville, South Carolina, and any person we authorise to use the Movement Solutions Performance Cockpit (“the Software”).

2. What the Software is

The Software is an internal reporting tool. It reads business data belonging to Movement Solutions, LLC from systems we already use, including our electronic medical record and our QuickBooks Online accounting file, and presents summary performance figures to our own staff.

The Software is not sold, licensed, offered or made available to the public, to patients, or to any other business. It is not a commercial product.

3. Licence

We grant authorised users a limited, non-exclusive, non-transferable, revocable licence to use the Software for the internal business purposes of Movement Solutions, LLC. That licence ends when your authorisation ends.

4. What you may not do

  • Use the Software for anything other than our internal business purposes.
  • Copy, publish, sell, sublicense or otherwise distribute the Software or its output to anyone outside Movement Solutions, LLC without our written consent.
  • Attempt to access data through the Software that you are not authorised to see.

5. Data

The Software reads data from third party systems using credentials held by Movement Solutions, LLC. Access to accounting data is read only. The Software does not create, alter or delete records in QuickBooks Online, and it does not move money.

Reports produced by the Software may contain patient names and treatment history. Handle them as protected health information and in accordance with our Privacy Policy and applicable law, including HIPAA.

6. Third party services

The Software connects to services operated by others, including Intuit Inc. and our medical records provider. Your use of those services remains subject to their own terms. We are not responsible for their availability or for changes they make.

7. No warranty

The Software is provided “as is”, without warranty of any kind, express or implied. Figures it reports are for internal management use and are not audited, are not financial statements, and are not financial, tax, legal or clinical advice.

8. Limitation of liability

To the fullest extent permitted by law, Movement Solutions, LLC is not liable for any indirect, incidental or consequential loss arising from use of the Software, or for decisions taken in reliance on its output.

9. Changes and termination

We may change or withdraw the Software, or update this agreement, at any time. Continued use after a change means you accept it.

10. Governing law

This agreement is governed by the laws of the State of South Carolina.
